Prosecutor seeking Trump's taxes cites probe of his business

In Trump's filing in late July, his lawyers argued that the scope of the subpoena was overbroad as it requested for "voluminous documents" beyond the district attorney's limited jurisdiction under NY law and was not properly tailored for Trump's records.

The district attorney made the argument in a filing responding to Trump's new challenge against the prosecutor's subpoena seeking the president's tax returns as part of a grand jury probe.

Lawyers for Mr Vance said public reporting demonstrated that, at the time the subpoena was issued, there were "public allegations of possible criminal activity at plaintiff's New York County-based Trump Organization dating back over a decade".

'These reports describe transactions involving individual and corporate actors based in New York County, but whose conduct at times extended beyond New York´s borders.

Trump continues to fight the demand on his longtime accounting firm, Mazars, despite a historic Supreme Court ruling that he was not entitled to immunity while in the Oval Office and had to comply like any other citizen.

"Every day that goes by is another day (Trump) effectively achieves the "temporary absolute immunity" that was rejected by this Court, the Court of Appeals, and the Supreme Court".

Marrero has scheduled arguments to be fully submitted by mid-August.

In July, the Supreme Court rejected Trump's legal argument that the sitting president was immune from a state criminal investigation. One of them, a Washington Post story published past year, reported that Trump had inflated his net worth to potential lenders and investors. He said he plans to publish a book critical of the president before the November election.

Vance sought the tax records in part for a probe of how Cohen arranged during the 2016 presidential race to keep the porn actress Stormy Daniels and model Karen McDougal from airing claims of extramarital affairs with Trump.

Vance cited news reports and an article referencing former Trump lawyer Michael Cohen's congressional testimony in the filing.

Even if NY prosecutors obtain Trump's tax records, it's unlikely that they will go public before the election, as grand jury investigations are kept private. The federal government, which was also involved in the case, argued that a state grand jury subpoena for personal records of a sitting president should meet a higher standard of need.
