The death sentence for Dzhokhar Tsarnaev, who was behind the 2013 Boston Marathon Bombing, was overturned by a federal appeals court on Friday.

Lawyers for Tsarnaev have acknowledged that he and his older brother Tamerlan, who was killed during the manhunt that followed the 2013 bombing, detonated two homemade pressure cooker bombs that killed three people and wounded at least 260 others near the finish line of the annual foot race. Tsarnaev was killed in a gun battle with police days after the bombing.

The trial judge sentenced Dzhokhar to death after the jury found that he deserved the death penalty for 6 of the 17 death-eligible charges in 2015. So Tsarnaev could again be sentenced to death, but the government must first decide whether it wants to pursue capital punishment.

The decision was made by a three-judge panel of the 1st U.S. Circuit Court of Appeals after they concluded that the judge who oversaw the case did not properly screen jurors for biases.

The decision cites two errors: the judge in Tsarnaev's convictions did not meet Patriarca standards and denied Tsarnaev's post-trial motion for judgments of acquittal.
