Appeals Court Tosses Boston Marathon Bomber’s Death Sentence, Orders New Penalty Trial

Court overturns Boston Marathon bomber's death sentence

"Just to be crystal clear", the court wrote, "Dzhokhar will remain confined to prison for the rest of his life, with the only question remaining being whether the government will end his life by executing him".

The death sentence for Dzhokhar Tsarnaev, who was behind the 2013 Boston Marathon Bombing, was overturned by a federal appeals court on Friday.

Lawyers for Tsarnaev have acknowledged that he and his older brother Tamerlan, who was killed during the manhunt that followed the 2013 bombing, detonated two homemade pressure cooker bombs that killed three people and wounded at least 260 others near the finish line of the annual foot race. Tsarnaev was killed in a gun battle with police days after the bombing.

She added, "He is a threat to all of us and he needs to die". "The death penalty should be used in this particular case".

Survivors of the Boston Marathon bombing and their relatives expressed a range of emotions following the Friday ruling from a federal appeals court overturning the death sentence for Dzhokhar Tsarnaev.

Haslet has since become an advocate for amputees, FOX affiliate Boston 25 reported. Gregory, 32, a young mother, also lost a leg as a result of the attack.

As for Tsarnaev, the appeals court believed some of the jurors in his trial were not completely truthful about how much information they had about the case while being selected.

Thompson said the pervasive news coverage of the bombings and their aftermath featured "bone-chilling" photos and videos of Tsarnaev, now 27, and his brother carrying backpacks at the marathon and of those injured and killed near its finish line.

"And in any case, he won't be getting out and hasn't been able to harm anyone since he was captured", he wrote in a tweet.

"Today's death reversal doesn't change me or my husband's happiness".

Former Massachusetts Bay Transportation Authority officer Dic Donohue, who was severely injured in a gunfight with the brothers, said the ruling was not surprising to him. "No sentencing will ever change that".

The trial judge sentenced Dzhokhar to death after the jury found that he deserved the death penalty for 6 of the 17 death-eligible charges in 2015. So Tsarnaev could again be sentenced to death, but the government must first decide whether it wants to pursue capital punishment.

The decision was made by a three-judge panel of the 1st U.S. Circuit Court of Appeals after they concluded that the judge who oversaw the case did not properly screen jurors for biases.

The decision cites two errors: the judge in Tsarnaev's convictions did not meet Patriarca standards and denied Tsarnaev's post-trial motion for judgments of acquittal.
