California attorney general will end fight against Sprint, T-Mobile merger

Given it is now approaching mid March, and Tunney Act ruling has not been made, T-Mobile and Sprint might have to wait a little longer to officially celebrate a merger they've been trying to make happen since 2018.

California and other states which had fought a merger of Sprint Corp and T-Mobile US over concerns about higher prices for consumers and less innovation have agreed to end their opposition to the deal in a settlement with the companies, Reuters reports.

The California attorney general's office announced Wednesday that it would not appeal a federal court decision approving the $ 26 billion T-Mobile and Sprint merger.

"Our coalition vigorously challenged the T-Mobile / Sprint telecommunications merger because of concerns that it would frustrate competition and leave consumers with higher prices", said Attorney General Xavier Becerra."The most important thing is that today's agreement ensures new jobs and protections for vulnerable consumers, and extends access to telecommunications services for our most underserved and rural communities". NY has already said it will not appeal the defeat.

The companies said the deal would benefit consumers by helping the companies build a better next-generation, 5G wireless network than each could do alone.

The notice said the state reached a settlement with the companies but did not elaborate. The agency endorsed the deal last year, but only on condition that T-Mobile and Sprint divesting some assets to satellite provider Dish Network, and allow Dish to use T-Mobile's network for seven years.

According to The Verge, T-Mobile and Sprint came to a settlement with California that will have The New T-Mobile making low-priced mobile plans available in that state for the next five years and creating around 1,000 new jobs in California while maintaining all of the ones that are already there.

Separately on Wednesday, an administrative judge with the California Public Utilities Commission (CPUC) issued a decision approving the proposed merger on condition the companies meet milestones: for example, giving almost all of California 5G networks by the end of 2026, with download speeds of at least 100 megabits per second. A California utility board has also not approved the deal yet.

Among others, U.S. District Court Judge Timothy Kelly in Washington, D.C. must still approve conditions set by the Department of Justice.

T-Mobile has said that it expects to close the deal as early as April 1. New T-Mobile will have the largest chunk of mid-band spectrum of any carrier except for Dish.
