New Footage of Roger Stone Arrest Just Released
"The order would be supported by a finding that there is a substantial likelihood that extrajudicial comments by trial participants will undermine a fair trial", Mueller's team said.
Stone, who has given a number of interviews since his arrest denying all the allegations against him, fought back in a court filing.
U.S. District Judge Amy Berman Jackson is considering issuing a gag order in Stone's case to prevent any impact on potential jurors.
Stone accuses the prosecutors of "shopping for a preferred district judge".
His attorney pointed out that Stone's career is writing about politics and he is familiar to those following the U.S. politics, but argued that the consultant is "hardly ubiquitous in the larger landscape of popular consciousness". He noted that prior restraints against free speech must be addressed with strict scrutiny, and that there must be "a clear and present danger to the seating of an impartial jury", in order to keep him from talking. "Any attempt to foresee the future effect of free speech on jury selection is a hazardous endeavor", they wrote.
Stone's defense team mentioned the reality star in its eight-page memo objecting to a gag order to argue that he didn't have the celebrity or ability to influence that Jackson suggested. Prosecutors are not asking for a blanket ban on Stone appearing publicly or discussing matters unrelated to his case.
"The footage depicts what you'd expect if the Federal Bureau of Investigation raided the home of a Mexican drug lord, maybe even SEAL Team 6 going into [Osama] bin Laden's compound", Carlson said. US intelligence agencies have said that Russia was the source of the hacked material, and previous year Mueller charged 12 Russian intelligence officers in the hacking.
Prosecutors said the two share a common search warrant, and "there are activities which are a part of the same alleged criminal event or transaction", according to Stone's filing.
Stone's lawyers also filed an objected to Jackson presiding over the case considering her involvement in other Mueller indictments, Politico reports. But in a separate filing Friday, Stone argued prosecutors have not produced sufficient evidence to show the relation. He has said he only sought to encourage voter interest in the group's public disclosures.
Carlson also took issue with the way the raid was conducted. "It's called politics, and they haven't criminalized it, at least not yet", Stone said a week ago on ABC's "This Week".
