Trump cuts 'disaster' court out of trans military ruling


The White House issues new policies banning most transgender Americans from servicing in the USA military; Leland Vittert reports.

President Trump has asked the Supreme Court to review his policy of banning transgender people from serving in the military, bypassing an appeals court that he has called "a complete and total disaster".

Last year, Trump said on Twitter, the military "cannot be burdened with the tremendous medical costs and disruption that transgender in the military would entail".

He writes because of the injunctions, "the military has been forced to maintain that prior policy for almost a year" despite a determination by Mattis and a panel of experts that the "prior policy, adopted by (Defense Secretary Ash Carter), posed too great a risk to military effectiveness and lethality".

In March, the president officially authorized the Pentagon to ban transgender individuals from enlisting in the military, with limited exceptions.

Between 4,000 and 10,000 USA active-duty and reserve service members are believed to be transgender.

The American Psychiatric Association defines gender dysphoria as a "clinically significant distress" due to a conflict between a person's gender identity and their sex assigned at birth.

The new policy approved by President Trump allows current transgender service members with gender dysphoria to continue serving if they were diagnosed after the Obama administration's policy took effect.

The US government is appealing those decisions.

While the US Court of Appeals for the 9th Circuit has heard arguments but not yet issued an opinion; the US Court of Appeals for the DC Circuit is scheduled to hear an appeal of the ruling in December, the Post noted. "There is no valid reason to jump the line now and seek U.S. Supreme Court review before the appellate courts have even ruled on the preliminary issues before them".
