Judge halts deportation of mother and daughter, threatens Jeff Sessions with contempt

Judge orders government to turn around deportation plane

Immigration officials have returned a mother and daughter to the United States after they were deported, which had angered a federal judge who was hearing their lawsuit.

But Attorney General Jeff Sessions, along with Homeland Security Kirstjen Nielsen and other officials, could face consequences for the government's handling of the case if the judge believes they did not fully comply with his orders.

District Judge Emmet Sullivan had been assured the pair would not be deported to El Salvador before midnight Thursday.

The case is Grace v. Sessions, 1:18-cv-01853, in U.S. District Court for the District of Columbia.

Sullivan agreed with the ACLU that the immigrants they were representing in a federal lawsuit should not be deported while their cases were pending.

The ACLU was in court today successfully seeking an emergency stay of removal for plaintiffs - many of whom are women fleeing extreme sexual and gang violence.

In addition to ordering the government to get the mother and daughter back, Sullivan blocked the Trump administration from deporting eight other immigrants - now held in detention - who are part of the same lawsuit against the government for allegedly wrongfully rejecting their claims for asylum.

Earlier this year, the Justice Department made it more hard for immigrants claiming to be victims of domestic or gang violence to get asylum.

Justice Department attorney Erez Rueveni told the judge that he wasn't aware of the impending deportation, and couldn't immediately confirm the location of Carmen and her daughter. Several coworkers at the factory where Carmen worked had been murdered, and her husband is also abusive, the records state.

But during a court recess, ACLU lawyers found out that the woman and her daughter had already been moved from the South Texas Family Residential Center - the nation's largest detention facility for illegal immigrants and other potential deportees.

Under the fast-track removal system, created in 1996 under President Bill Clinton, asylum seekers are interviewed by an asylum officer to determine whether they have a "credible fear" of returning home. As part of that decision, Sessions said gang and domestic violence in most cases would no longer be grounds for receiving asylum.

"The new policies unlawfully elevate the credible fear standard far above the low threshold Congress enacted and prevent asylum seekers from ever pursuing their asylum claims", the suit says.

Two of the children and their mothers were deported before the suit was filed; the rest were being detained in Texas and NY.

During the hearing, the judge ordered a temporary stay on deporting the nine women and three children who filed the lawsuit, according to a court filing.
