Butowsky went on to state that he has communications between himself and the couple that he says substantiate the core of the theory promoted by the Fox News article-that Rich provided WikiLeaks with emails.
Since their son's murder, the Rich family has consistently had to refute the idea of a connection between Seth and Wikileaks. The Riches say in the lawsuit that Butowsky convinced them to accept Wheeler's help as a private investigator after assuring them that Wheeler would share his findings only with them.
Butowsky, for his part, claims that he didn't write the piece, and that including him in the lawsuit is "baseless and frivolous".
The Rich family would have to demonstrate that Fox News's actions were "outrageous", which sounds colloquial but is actually a technical term and "a fairly high standard", according to Doris Brogan, a law professor at Villanova University.
The lawsuit claims that Joel and Mary are experiencing symptoms consistent with post-traumatic stress disorder, obsessive-compulsive behavior, and Mary is experiencing symptoms consistent with Social Anxiety Disorder. The family notes it has installed three security cameras outside its house to "detect unwanted visitors".

In a statement on Tuesday, Joel and Mary Rich wrote: "The pain and anguish that comes from seeing your murdered son's life and legacy treated as a mere political football is beyond comprehension". They are suing all three parties for intentional infliction of emotional distress, aiding and abetting intentional infliction of emotional distress, conspiracy to commit intentional infliction of emotional distress, and tortious interference with contract; they are also suing Fox News for negligent supervision and/or retention. The Rich family lawsuit claims that Fox News, reporter Malia Zimmerman and guest Ed Butowsky "sought to take the conspiracy theory from the fringe to the front pages and screens of the mainstream media".
When reached for comment on Tuesday, Butowsky claimed the lawsuit was "one of the dumbest" he'd ever seen, according to ABC News. "Mr. and Mrs. Rich should come forward and be honest with people", he said.
Butowsky said that Joel Rich had been "very happy with the article" when it was initially published.
