Paul Manafort sues, argues Robert Mueller overstepped bounds

Paul Manafort, President Trump's former campaign chairman, sued the Department of Justice; the deputy attorney general, Rod J. Rosenstein; and the special counsel, Robert S. Mueller III, on Wednesday over the investigation into possible connections between Mr. Trump's associates and Russian election interference.

President Donald Trump's former campaign chairman is suing special counsel Robert Mueller and the Justice Department after he was indicted as part of the Russian Federation investigation.

But Shugerman says the suit may end up proving just the opposite.

The government's October 27 indictment accuses Manafort and a longtime associate, Rick Gates, of failing to register as agents in the USA for political consulting they performed for Ukraine and for pro-Russian politicians there.

Although the Special Counsel statute survived a 1988 constitutional challenge in Morrison v. Olson, most legal scholars believe that Justice Antonin Scalia's lone dissent in that case was constitutionally correct. Some Republicans have begun publicly calling for Mueller's probe to be shut down.

The complaint alleges that the order violated "specific restrictions on the scope of such appointments".

A Justice Department spokesperson gave this statement to BuzzFeed and Politico: "The lawsuit is frivolous but the defendant is entitled to file whatever he wants".

Some of those subpoenas seek records from as early as 2005.

Manafort acknowledged in his complaint that his foreign business dealings have been of interest for years to federal prosecutors. Manafort's lawyers have resounded the President's feedback that Mueller's examination concerning Russian interfering in the 2016 race is seeking after wrongdoings that never happened. Manafort's indictment includes actions he took from 2006 to 2014.

Manafort's lawyers pushed back against the breadth of Mueller's inquiries.

Manafort claims that "Even if that grant of authority were lawful, Mr. Mueller's investigation and the resulting indictment exceed it".

He theorized that the suit could be a way for Manafort to get around a gag order that the judge in the criminal case has imposed.

Manafort's lawsuit, according to MSNBC, says the DOJ interviewed him in 2014 and didn't indict him.

Manafort also claims he told prosecutors about his offshore banking activity in Cyprus.

Nick Akerman, a partner at Dorsey & Whitney and a former Watergate prosecutor, agreed with the Justice Department.

Mr Rosenstein appointed Mr Mueller past year and oversees the special counsel's operations.

Manafort's claim noticed that amid his chance working for the Ukrainian government he met consistently with the U.S. minister in Kiev, recommending that the United States government realized what he was doing at the time.

By filing a separate lawsuit, Mr. Manafort's lawyer, Kevin Downing, also creates the possibility of a protracted fight over Mr. Mueller's authority.

Manafort, along with his longtime business partner Rick Gates, were formally charged on 30 October in an indictment that cited detailed evidence of money movements through overseas shell companies and the purchase of properties in NY and elsewhere.

Legal sources say Mr. Mueller is likely to bring a new indictment charging Mr. Manafort with tax evasion.
