California man files lawsuit against Apple for slowing down old iPhones

IPhone owners from several states sued Apple Inc. for not disclosing sooner that it issued software updates deliberately slowing older-model phones so aging batteries lasted longer, saying Apple's silence led them to wrongly conclude that their only option was to buy newer, pricier iPhones.

"Plaintiff is informed and believes that Apple was aware of a defect in his affected iPhone at the time he purchased a new one, and not only failed to disclose what it knew, but made deliberately misleading statements that were meant to hide the nature and scope of that defect", reads the complaint.

Earlier this week, Apple came under fire for allegedly slowing down old iPhone models intentionally. A similar lawsuit was filed on Thursday in Los Angeles.

Apple CEO Tim Cook.

The plaintiff, Keaton Harvey, previously lived in the Bay Area and filed with the San Ramon-based law firm Fazio Micheletti.

"Lithium-ion batteries become less capable of supplying peak current demands when in cold conditions, have a low battery charge or as they age over time, which can result in the device unexpectedly shutting down to protect its electronic components".

Meanwhile, smartphone operating software is perpetually improved with updates that typically increase appetites for electricity.

Apple acknowledged in a Wednesday statement that it introduced a fix so batteries wouldn't suddenly die.

The iPhone 6 made its debut in late 2014.

It said it released the fix for iPhone 6, iPhone 6s and iPhone SE and later extended it to iPhone 7.

Apple releases new iPhone models annually, and sales of the handsets power its money-making engine. While Apple did have a free battery replacement program in November 2016, it was limited only for iPhone 6s and 6s Plus.

Apple is being sued by a number of people.

Apple is in continuous highlight for this slowing down of CPU process and battery. Consumers also reported that when they reached Apple Store in regards to this issue, they encouraged to buy a new iPhone only.
