Senate To Defer Ndume's Resumption

Senate not ready to take Ndume back

Deputy President of the Senate, Ike Ekweremadu, who presided, announced after a brief closed door session that lawmakers resolved to give the nod to the resumption of the Borno born lawmaker.

The Senate had on March 30, 2017, suspended Ndume, for 90 legislative days for not "conducting due diligence" before filing a petition against the Senate President, Bukola Saraki and the lawmaker representing Kogi West Senatorial District, Senator Dino Melaye.

The Borno senator‎ had asked the senate to investigate the allegation that the red chamber was exacting vengeance on Hameed Ali, comptroller-general of the Nigeria Customs Service, because of a seized bullet-proof vehicle allegedly owned by Saraki.

Reacting to the court's verdict, Ndume noted that the Senate erred because it lacked the right to suspend a member more than two weeks, "which is what our rules say".

The Court also ordered he be paid his salaries and allowances in full.

Ndume was indicted "for bringing Senator Dino Melaye, his colleague, and the institution of the Senate to unbearable disrepute".

Both men had appeared before the Senate Committee on Ethics and privileges and were cleared of the allegations.

Although the senator last week, won a suit annulling his suspension, but the senate recalled the senator after he had served his suspension of 90 legislative days.

Ekweremadu said that the resolution was without prejudice to the legal tussle surrounding Ndume's suspension.

The Senate expressed optimism that the decision of the trial court would be overturned by the Court of Appeal.

"For the records, the Senate had challenged the jurisdiction of the Federal High Court to entertain the matter on the grounds that the Plaintiff wrongly joined several causes of action in his Originating Summons".

Mike Ozekhome, counsel to the senate, on Sunday said the upper legislative chamber "respectfully" disagrees with the judgment. An application for a stay of execution of the orders of the court will also be filed same time, " Ozokhome stated.
